These Terms are the legal agreement between you and Woofer LLC for using Woofer's websites, apps, features, and related services (the “Service”). By creating an account, accepting these Terms, or using the Service, you agree to them and to the Woofer Privacy Policy. If you do not agree, please do not use the Service.
Terms, in human words
- You must be at least 17 to use Woofer. Members under 18 may not access or post adult content.
- Your work stays yours. You give Woofer only the permissions needed to run the Service and show your content the way you choose.
- Where lawful adult imagery is allowed, eligible images must be labeled. A label never makes prohibited content acceptable.
- Harassment, hate, threats, doxxing, scams, impersonation, exploitation, and rights violations are not allowed.
- Moderation decisions are made by people. Automated tools, when enabled, only assist with reported content.
- Woofer is in beta: features may change, break, pause, or disappear.
1. Who operates Woofer
Woofer is operated by Woofer LLC in Kansas, United States. In these Terms, “Woofer” refers to Woofer LLC and the Service it operates.
2. Eligibility and accounts
Minimum age
You must be at least 17 years old to create or use a Woofer account.
Woofer may block or close an account if it reasonably believes the member is under 17. Birth information supplied during onboarding is used to apply age and safety rules. Once onboarding is complete, a birth date may be locked and may require a future verification process to correct.
Accurate information and one account
You must provide accurate account information and keep it current. You may not create an account for another person without authorization, impersonate anyone, or create accounts to evade a restriction, suspension, or ban. Unless Woofer expressly permits otherwise, each person may maintain one account and one Paw Page.
Account security
You are responsible for keeping your login credentials secure and for activity under your account. Use a unique password, do not share access, and notify Woofer promptly if you believe your account has been compromised. Woofer may require additional verification or temporarily restrict access when reasonably necessary to protect an account or the community.
Invite-only access
During closed testing, access may require an invite code. Invite codes are personal access tools, not property or currency. You may not sell, trade, scrape, guess, or misuse invite codes. Woofer may limit, disable, revoke, or change invite features to protect the Service or manage the beta.
3. The beta Service
Woofer is a developing social platform for the furry community, including profiles, Paw Pages, social posts known as Woofs, interactions, media uploads, and private messages. The exact features available to you may vary.
The Service is offered as a beta. You understand that it may contain errors, lose availability, change without advance notice, or include features that are incomplete or experimental. Woofer may add, change, suspend, or discontinue any part of the Service. We will try to provide reasonable notice when a change materially affects your rights, but urgent security, safety, legal, or operational changes may take effect immediately.
You are responsible for maintaining your own copies of content that is important to you. Woofer is not an archival or backup service.
4. Your content and the license you give Woofer
You keep ownership
You retain ownership of the artwork, text, images, audio, profile material, messages, and other content you submit, upload, publish, or transmit through the Service (“Member Content”). These Terms do not transfer ownership of your Member Content to Woofer.
Limited operating license
You grant Woofer a worldwide, non-exclusive, royalty-free license to host, store, reproduce, cache, encode, resize, crop, transcode, transmit, and display your Member Content only as reasonably necessary to:
- operate, secure, maintain, and improve the Service;
- display and deliver your content to the audiences you select;
- make technical copies and derivatives required for media processing, accessibility, compatibility, and performance;
- investigate reports, enforce these Terms, and comply with law; and
- use service providers acting for Woofer for those same limited purposes.
This license is sublicensable only to service providers and contractors helping Woofer perform those functions. It is not a license to sell your work, place it in advertising, merchandise it, or use it to train Woofer artificial-intelligence models.
The license ends when your Member Content is deleted from active systems, except to the extent copies remain in backups for a limited period, are retained as moderation or legal evidence, remain visible to another participant as described in Section 12, or must be retained by law.
Your responsibility for content
You represent that you have the rights and permissions needed to submit your Member Content and to grant the license above. You are responsible for your content and for choosing appropriate audience, privacy, adult-content, and accessibility settings. Do not upload confidential material or another person's personal information unless you have authority to share it.
No routine AI training
Woofer does not use Member Content to train Woofer AI models. If Woofer introduces an optional generative feature in the future, it will require separate, clear terms before your content is used for that purpose.
5. Community rules and acceptable use
You may not use the Service to create, upload, share, encourage, coordinate, or facilitate:
- illegal activity or content;
- sexual exploitation or abuse, sexual content involving minors, grooming, or any material that depicts, promotes, or normalizes the sexualization of minors;
- non-consensual intimate imagery, sexual violence, trafficking, coercion, or exploitation;
- credible threats, targeted harassment, stalking, hate, or incitement to violence;
- publication of private or identifying information without permission, including doxxing;
- scams, spam, deceptive schemes, malicious links, malware, phishing, or attempts to obtain credentials;
- impersonation or misleading affiliation with another person, organization, or Woofer staff;
- content that infringes copyright, trademark, privacy, publicity, or other rights;
- circumvention of age gates, content controls, account restrictions, rate limits, security systems, or moderation decisions;
- unauthorized access to accounts, data, systems, or nonpublic areas of the Service;
- scraping, bulk collection, automated account creation, or automated access that burdens the Service or has not been expressly authorized by Woofer; or
- conduct that materially disrupts the Service or prevents others from using it safely.
Context matters. Good-faith discussion, criticism, education, documentation, or artistic expression is not automatically prohibited merely because it addresses a difficult subject. But context does not excuse conduct that creates a serious safety risk, violates another person's rights, or breaks the law.
You must follow feature-specific instructions, upload limits, technical restrictions, and community notices presented in the Service. You may not falsely mark prohibited content as acceptable or use privacy settings to conceal prohibited conduct.
6. Adult content and age protections
Adults only
Only members who are 18 or older may access, reveal, or post adult or sexually suggestive content where Woofer permits it. Members who are 17 may not access, reveal, or post such content. Do not attempt to help someone under 18 bypass those protections.
Label eligible images
When a Woofer upload control offers an adult-content label, you must use it for adult or sexually suggestive imagery. Labels apply to each image, not automatically to an entire post or page. Labeling is a safety and consent requirement; it is not a defense to these Terms.
Adult-labeled media may be blurred by default for eligible adults. Depending on the viewer and feature, Woofer may withhold the media entirely rather than send blurred media. A person's ability to reveal a labeled image does not mean that every kind of adult content is allowed.
Content that is never allowed
The following remains prohibited everywhere on Woofer, including in private messages: sexual content involving minors; grooming; exploitation; trafficking; non-consensual sexual content; intimate imagery shared without permission; sexual threats; and content that is otherwise illegal. Avatars and any surface that does not support adult labeling must remain appropriate for that surface.
Woofer may remove or restrict adult content when needed to comply with law, app-store or hosting requirements, or community safety rules, even if the content was labeled. Product rules may differ by feature, device, platform, or country.
Private adult conversation
Lawful, consensual sexual discussion between adults in private messages is not prohibited merely because it is sexual. All other rules — including consent, age, exploitation, harassment, and illegality rules — still apply.
7. Private messages
Private messages are intended for the participants in the conversation. Woofer does not routinely read them. Messages are not end-to-end encrypted, however, and Woofer operates the systems that store and deliver them.
If a participant reports a message, the selected message and limited relevant context may be preserved and reviewed by authorized staff. Woofer may also access message information when reasonably necessary to investigate abuse or security incidents, protect people, comply with law, or enforce these Terms. Automated content screening, when enabled, does not include private-message content or reported-message snapshots unless Woofer first changes its policy and provides appropriate notice.
Do not assume that deleting a message from your own view removes every copy available to the other participant, from required evidence, or from limited backups.
8. Reporting, moderation, and appeals
Reports
Members may report content or conduct through available reporting tools. Reports should be made in good faith. Knowingly submitting false, duplicative, or abusive reports may itself violate these Terms. Reporter identity is kept confidential from the reported member except when disclosure is required by law or necessary for a fair process.
Moderation actions
Woofer may investigate suspected violations and take action it reasonably believes is appropriate, including adding or correcting a content label, limiting visibility, removing content, issuing a warning, restricting a feature, pausing or suspending an account, or permanently banning an account. Woofer may act without advance notice when needed to address an urgent safety, security, or legal risk.
Moderation decisions consider context and available evidence. Woofer cannot guarantee that it will identify every violation or resolve every report in a particular way or timeframe. A failure to act in one case does not waive the right to act later or in another case.
Human decisions and automated assistance
When enabled, automated systems may help classify content that a member has reported. Automated results are advisory and can be wrong. They do not by themselves hide content, label content, suspend an account, dismiss a report, or contact authorities. A human makes enforcement decisions. Private messages are excluded from this automated screening path.
Evidence and appeals
Removed content may be hidden from ordinary view while retained as evidence for moderation, safety, security, or legal purposes. If Woofer provides an appeal control or support path, you may appeal a content removal, adult-content label, suspension, or other eligible action. Appeals are reviewed by a person and, when practical, by someone other than the original reviewer. Appeal deadlines may be stated in the notice; where no different period is shown, submit the appeal within 14 days.
9. Copyright and other intellectual property
Respect the rights of artists, creators, and other members. Do not upload or share content unless you created it or have permission to use it in the way you are using it.
If you believe content on Woofer infringes your copyright, send a notice to Woofer's designated DMCA agent at contact@woofersocial.com with enough information to identify the copyrighted work, the allegedly infringing material (and where it appears on Woofer), your contact details, a statement that you have a good-faith belief the use is not authorized, a statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act for the owner, and your physical or electronic signature. You may also use the in-app report control and choose “Copyright or intellectual property,” which flags the report for that agent. Privacy questions still go to privacy@woofersocial.com. Woofer may ask for additional information and may remove or restrict material while reviewing a claim. Repeated infringement may result in account restrictions or termination.
Woofer's software, visual design, branding, logos, and other materials that are not Member Content belong to Woofer or its licensors and are protected by applicable law. Subject to these Terms, Woofer gives you a limited, personal, revocable, non-exclusive, non-transferable right to access and use the Service for its intended purpose. You may not copy, sell, reverse engineer, distribute, or create derivative works from the Service except where applicable law permits it despite this restriction.
10. Feedback
If you voluntarily send ideas, suggestions, bug reports, or other feedback about Woofer, you grant Woofer a perpetual, worldwide, non-exclusive, royalty-free right to use, adapt, and act on that feedback without payment or attribution. This section does not change your ownership of Member Content posted through ordinary creative or social features.
11. Privacy
The Woofer Privacy Policy explains how Woofer collects, uses, shares, stores, and protects information. It is incorporated into these Terms. Privacy and audience settings help control visibility, but no online service can guarantee absolute confidentiality or security. Do not share content you are not prepared to have seen by its intended audience or as otherwise described in the Privacy Policy.
12. Account restrictions, termination, and deletion
Stopping use
You may stop using Woofer at any time. You may request account deletion through available account controls or by contacting Woofer. Before deleting your account, save any content you want to keep.
Deletion process
When a deletion request is accepted, Woofer may hide the account and its public content immediately and provide a 14-day cancellation period. After that period, Woofer may delete or anonymize the member's profile, Paw Page, Woofs, artwork, uploads, and associated social totals, subject to the exceptions below.
Messages already sent may remain visible to the other participant under a label such as “Deleted User” so that the other person's conversation is not destroyed. Woofer may retain records reasonably necessary for safety, fraud prevention, security, moderation, dispute resolution, or legal compliance. Backup copies may remain temporarily until they are overwritten through ordinary retention cycles. A deleted username may be reserved for one year before reuse and may require administrative approval.
Action by Woofer
Woofer may restrict, suspend, or terminate access if you breach these Terms, create risk or legal exposure, threaten the safety or integrity of the Service, or if Woofer is required to do so by law. Where reasonable, Woofer will explain the action and provide an appeal path. Serious or urgent cases may require immediate action without prior notice.
If the Service or a material part of it is discontinued, Woofer will try to give reasonable notice and a reasonable opportunity to retrieve available content, unless doing so would create a safety, security, or legal risk.
13. Third-party services and content
Woofer relies on service providers for functions such as authentication, hosting, media delivery, email, and optional catalog searches. The Service may also link to third-party websites, media, or services. Third parties may have their own terms and privacy policies, and your use of their services is governed by those terms.
Woofer does not control and is not responsible for third-party services, content, availability, security, or practices. A link, embed, catalog result, or integration does not imply endorsement. You are responsible for complying with third-party rights and terms when you add music, artwork, links, or other outside material to Woofer.
14. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Woofer disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Woofer does not promise that the Service will be uninterrupted, secure, error-free, or available in every location or on every device; that content will be preserved; or that every member will follow these Terms.
You use the Service and interact with other members at your own discretion. Woofer does not control members' offline conduct and is not responsible for arrangements, transactions, or meetings between members. Use appropriate caution, especially before sharing personal information or meeting someone in person.
Some jurisdictions do not allow certain warranty disclaimers. In that case, these disclaimers apply only to the extent permitted by law, and you keep any rights that cannot legally be waived.
15. Limitation of liability
To the fullest extent permitted by law, Woofer and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising from or related to the Service or these Terms, even if advised that such damages were possible.
To the fullest extent permitted by law, Woofer's total aggregate liability for all claims arising from or related to the Service or these Terms will not exceed the greater of US $100 or the amount you paid directly to Woofer for the Service during the 12 months before the event giving rise to the claim.
These limits do not apply where liability cannot legally be limited, including liability that applicable law makes non-waivable. The limitations apply to the maximum extent permitted even if a remedy fails of its essential purpose.
16. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Woofer and its contractors and service providers from third-party claims, damages, losses, liabilities, and reasonable costs arising from: your Member Content; your unlawful use of the Service; your material breach of these Terms; or your violation of another person's rights.
Woofer will give you reasonable notice of a covered claim and may control the defense and settlement. You may not settle a claim in a way that admits fault by or imposes obligations on Woofer without written consent. This section does not require indemnification for Woofer's own unlawful conduct and does not apply where prohibited by law.
17. Disputes and governing law
Informal resolution
Before filing a formal legal claim, you and Woofer agree to try in good faith to resolve the dispute informally for at least 30 days. Send a written description of the problem and the relief requested to privacy@woofersocial.com. This requirement does not prevent either side from seeking urgent injunctive relief or using an eligible small-claims process.
Governing law and courts
These Terms are governed by the laws of the State of Kansas and applicable United States federal law, without regard to conflict-of-law rules. Any dispute not resolved informally must be brought in a state or federal court with jurisdiction in Kansas, and you consent to those courts' personal jurisdiction.
If the consumer-protection laws where you live give you rights or access to courts that cannot be waived by contract, this section does not take those rights away.
18. Changes and general terms
Changes to these Terms
Woofer may update these Terms as the Service or law changes. The updated Terms will show a new “Last updated” date. For material changes, Woofer will provide additional notice and may require you to accept the revised Terms before continuing to use the Service. Changes do not retroactively alter a dispute that arose before the changes took effect unless the law permits and both sides agree.
Entire agreement
These Terms and the Privacy Policy are the entire agreement between you and Woofer about the Service, unless additional terms are presented for a specific feature. Feature-specific terms control only for that feature and only where they conflict with these Terms.
Severability and waiver
If a court finds part of these Terms unenforceable, that part will be enforced to the maximum extent permitted and the rest will remain in effect. If Woofer does not enforce a provision immediately, that does not waive the right to enforce it later.
Assignment
You may not assign or transfer your rights or obligations under these Terms without Woofer's written consent. Woofer may assign these Terms in connection with a reorganization, sale, transfer of the Service, or change in control, subject to applicable law.
No third-party beneficiaries
These Terms do not create rights for anyone other than you and Woofer, except that Woofer's service providers may rely on Sections 14 through 16 where applicable.
Survival
Provisions that by their nature should survive termination — including ownership, licenses needed for retained content, moderation evidence, disclaimers, liability limits, indemnity, disputes, and general terms — will survive.
Electronic communications
You agree that notices and communications may be provided electronically through the Service or to the email address associated with your account. You are responsible for keeping that address current.
